Issuance of a permit for the child to travel abroad
(power of attorney to take the child abroad)

In this short review, I will try to answer the most common questions related to the departure of children.

1) when is a "power of attorney" required for the child's departure?
- if the child has not reached the age of 16 and is traveling accompanied by one of the parents, then a notarized permit must be issued from the other parent.

2) what documents must be presented at customs control when traveling with a child?
- the child's birth certificate or (its notarized copy), notarized permission from the second parent.

3) what documents and data must be provided to the notary in order to issue a permit for the child to leave?
- the parent who will not be accompanying the child comes to the notary to issue the permit and submits the passport, identification code and birth certificate of the child. The full name and date of birth of the accompanying father are also reported (his presence is not mandatory).

4) is it possible to issue a power of attorney for the departure of a child without a father/mother on their behalf, since they are abroad/in the hospital, i.e. WITHOUT THEIR PERSONAL PRESENCE AT THE NOTARY?
- POWER OF AUTHORITY for the child's departure is drawn up and signed personally. If the father/mother is abroad, they can issue such a power of attorney at a foreign notary public (or at the consulate of Ukraine), affix an apostille and send it to Ukraine. In Ukraine, a translation of such a power of attorney is made by a translation bureau or with a notarized translation. You can always get the approximate text of such a power of attorney by contacting a notary in Ukraine and sending it to the other parent.

6) if the parents are divorced, is it necessary to issue a power of attorney for departure from the other parent?
- it is necessary! Divorce does not remove parental rights. The application is not required only if one of the parents was deprived of parental rights by court order, if the other of the parents is a foreigner, if there is a court decision on the right of the child to leave without the consent of the other of the parents.

7) IF YOUR CHILD IS 16 OR MORE 16 YEARS OLD, THEN IT IS NOT NECESSARY TO FORM A "POWER OF AUTHORITY" FOR DEPARTURE!!!! According to Art. 313 of the Civil Code of Ukraine
