Recommendations of the notary regarding the preparation of documents for the execution of the contract of purchase and sale of an apartment. List of necessary documents for registration, as well as current information on taxes and payments.
1. Documents required for the execution of an apartment purchase and sale agreement:
Documents of the parties - the Seller and the Buyer:
– Passport (a passport in which a photo was not pasted upon reaching the age of 25 and 45 is considered invalid);
– Identification code;
– Application-consent of the second spouse to sign the contract (required if the person is married and if the real estate object was bought during the marriage. If the real estate object belongs to the Seller under a gift agreement or was inherited, then the consent of the second spouse is not required);
2. Documents for the apartment:
– Document confirming ownership;
– Expert assessment;
– Certificate of those registered in the apartment (form No. 3)
3) Taxes and other payments upon execution of the contract of purchase and sale of an apartment:
- Contribution to the pension fund - 1% from the amount of the contract
– Tax on the sale (exchange) of real estate*
– Payment in the amount of state duty (1% from the amount of the contract)
- Fee for notarization of the contract (according to Article 31 of the Law "On Notary" - by agreement).
* Tax on the sale (exchange) of real estate objects arises if:
– the real estate object has been owned by the seller for less than 3 years (with the exception of inherited property)
– in the current year, the seller carries out the 2nd or more alienation of real estate objects
The tax amount will be 5% for residents and 15-17% for non-residents.
